Join us for an AIA-accredited hour with Keith Bergeron and Kelly Theard of Deutsch Kerrigan Law Firm, as they describe the history of delegated design, it’s potential uses, and creating performance specifications to successfully transfer design responsibilities from the designer of record to a specialty designer working for the general contractor. The importance of the use of coordinated standard contract form language will be emphasized. The process to review delegated design elements, shop drawings, and submittals will be discussed with examples from litigated matters involving delegated design. Legal cases in Louisiana and other jurisdictions involving delegated design risks will be reviewed in order to understand what went wrong and how to avoid those risks on the attendees future slate of design and construction administration projects.
