This session delves into crucial legal subjects pertinent to the architectural profession. Led by seasoned experts in the legal field, attendees can expect insightful discussions on topics ranging from legal planning to the Louisiana Public Works Act.

Changes to the Louisiana Public Works Act & Compliance with Keith Bergeron of Deutsch Kerrigan

The Louisiana Public Works Act contains all of the laws related to preparing design documents, the advertisement for bids, award and close out of a construction contract for a public entity. Louisiana licensed architects must have intimate knowledge of this act if they practice in the public arena. The Louisiana legislature constantly amends and changes the various statutes in the act each session, including the latest session held. Keith’s presentation will provide the attendees with the recent updates to the act and how to integrate the changes into their upcoming projects.

There Is No Perfect Set of Plans: Who Pays? with Jonathan Forester and Chris LeMieux of Riess Lemieux LLC

Riess LeMieux will discuss the reasons that a perfect set of plans don’t exist and the architect and engineer’s standard of care relative to plan changes (how much should owner’s expect to pay in change orders for plan refinements during the course of the project?). They will also discuss contractual requirements (What is “reasonably inferable” from a set of plans?). The discussion will also focus on the responsibilities of other stakeholders. Owners have responsibilities to make decisions; contractors must coordinate and work with the owner and architect when they make mistakes or suggest value engineering items. Finally, some changes are unavoidable, such as those resulting from concealed conditions. All of these will be discussed in the context of different delivery methods – design-bid-build; negotiated; Construction Manager at Risk (CMAR); and design-build.
